*Regulations on Prevention and Handling of Sexual Harassment and Sexual Violence


Chapter 1 : General Provisions


[Article 1 : Purpose]

In accordance with Article  of the Act on the Prohibition and Relief of Sexual Discrimination and Article  of the Enforcement Decree of the same Act, this regulation protects members of STEKOM University from sexual harassment and violence, measures to eradicate them, and the organization and operation of the Sexual Harassment and Sexual Violence Counseling Center. The purpose is to stipulate necessary matters regarding


[Article 2 : Definition]

The definitions of terms used in this regulation are as follows. Sexual harassment is any act that causes sexual shame or disgust, regardless of whether it constitutes a sexual offense.

1. An act of violating an individual's sexual autonomy through verbal, mental, or physical acts, such as sexual behavior and demands that the other party did not consent to.

2. Acts of giving disadvantages in academic evaluation, employment, personnel affairs, etc. for reasons of non-compliance with the act in subparagraph 1 or gender difference.

3. Acts that create an unfair environment based on gender differences.

4. An act in which a person who sympathizes with a person who commits an act of sexual harassment inflicts considerable damage on the victim by means of mental threats, physical coercion, or other means.

Sexual violence refers to acts of sexual violence according to the Criminal Act and the Act on Punishment of Sexual Crimes and Protection of Victims.

The parties to the case refer to the victim and the accused.


[Article 3 : Scope of Application]

This regulation targets faculty (including part-time lecturers and teaching assistants), staff (including temporary and daily workers), researchers, and students (including students on leave) of the school.


[Article 4 : Confidentiality]

A person who is in charge of or involved in the investigation of a case of sexual violence shall not divulge to others any information he or she has come to know in the course of his or her duties, such as the personal information of the victim.


Chapter 2 Sexual Harassment and Sexual Violence Counseling and Handling Institutions


Section 1 Sexual Harassment/Sexual Violence Counseling Office


[Article 5 : Installation]

Establish and operate the Sexual Violence Counseling Office (hereinafter referred to as the Counseling Room) within the Office of Education to expeditiously handle sexual assault cases and provide protection and counseling for victims. In addition, a report box for sexual harassment and sexual violence is installed in the Office of Education.


[Article 6 : Composition]

To carry out the work of the counseling office, the head of the counseling office and some counseling professors are appointed.

1. The head of the Counseling Office is the Dean of Academic Affairs, and the Counseling Professor is a teacher who is a full-time lecturer or higher at the school and is appointed by the President at the recommendation of the Head of Counseling Office.

2. If necessary for the performance of the counseling office's work, a few staff members or assistants may be employed.


[Article 7 : Business]

The duties of the counseling office are as follows.

1. Counseling on sexual violence

2. Receiving reports of victims of sexual violence

3. Education and publicity to prevent sexual violence incidents

4. Reporting requests for handling sexual violence incidents to the Sexual Ethics Committee


Section 2 Sexual Harassment/Sexual Violence Student Guidance Committee


[Article 8 : Composition]

1. The Sexual Harassment/Sexual Violence Student Guidance Committee is in charge of the Student Guidance Committee, a permanent body of the university, and consists of up to five members appointed by the President from among the Student Guidance Chairperson and the Student Guidance Committee.

2. Deliberation of matters related to sexual harassment and sexual violence. At the time of resolution, the chairperson may appoint two female students from among the executive members of the student council as student members.


[Article 9 : Function]

The Student Guidance Committee may deliberate and resolve the following matters regarding sexual violence.

1. Investigation and handling of sexual violence cases

2. Request for disciplinary action against perpetrators of sexual violence

3. Other important matters related to sexual violence


[Article 10 : Meeting]

*The chairperson convenes the committee and becomes its chairman.

*Meetings are convened in the following cases.

1. When the chairperson deems it necessary

2. When there is a request from more than one-third of the committee members

3. When a request is made to handle a sexual assault case

*The meeting is decided by the attendance of a majority of the members present and the consent of a majority of the members present.

*Meetings regarding the handling of sexual violence cases shall be closed.


Chapter 3 Handling of Sexual Harassment and Sexual Violence Cases


[Article 11 : Consultation]

1. When the head of the counseling office receives a request for counseling or a report from a victim or agent, he/she shall designate a counseling professor to faithfully respond to counseling and take necessary measures such as mediation with the concerned person.

2. If the head of the counseling office judges that the victim's damage is equivalent to sexual violence through counseling, he or she shall refer the case to the Committee and request its handling.


[Article 12 : Processing]

*The Committee deliberates and resolves the case referred in Article 11 and handles it as follows|

1. Provision of information on civil and criminal legal remedies to the victim or other necessary support measures

2. Request for disciplinary action against the perpetrator in accordance with school rules and related regulations

3. Guidance on apology and compensation to the perpetrator, taking into account the request of the victim

4. Other necessary measures for handling the case

*The committee shall report the outcome of the case to the president and notify the victim and the reporter.

*(Effective Date) This regulation is effective from November 12, 2021.
